We provide a specialist service when it comes to complex and discrete immigration issues. We can assist with a whole range of complex matters, including the following:

 

Health Waivers

If you or any members of your family don’t meet the health requirements for your visa, it may be refused. In some circumstances, a waiver of the health requirements can be granted. We have experience in preparing health waiver applications and supporting submissions which have produced positive results for our clients.

Condition 8503 Waiver

If your current visa contains this ‘no further stay’ condition, this will generally mean that you cannot lodge another visa application onshore. There are however many circumstances were this conditions can be waived. We have experience in preparing submissions which which have resulted in this condition being waived.

Character Submissions

If you have a criminal history, a history of non compliance with visa conditions, have been refused entry to, or have been deported from another country you may have some character issues which need to be addressed in your application. We can advise you on the impact your particular character issues may have and assist with a character submission in support of your application.

Notice of Intention to Cancel + Visa Cancellations

Under the Migration Act and Migration Regulations, the Minister for Home Affairs has a range of powers available when considering cancelling your visa. Before you visa is cancelled however, you will be issued with a Notice of Intention to Cancel and be invited to respond. This is your opportunity to to explain why your visa should not be cancelled. You can also provide any relevant evidence to support your arguments. We can assist in drafting a strong response and supporting submission to ensure your circumstances are properly taken into account and that any incorrect findings or conclusions are explained. If your visa is cancelled, you may have review rights which we can advise you on.

PIC (Pubic Interest Criterion) 4020

The Public Interest Criterion 4020 will result in the refusal of a visa if an applicant has provided ‘bogus’ documents, provided misleading or false information or if you have not provided sufficient evidence as to your identity. If your visa is refused under PIC 4020 exclusion periods will often apply, during which time you cannot be granted any further visas. If you are put on notice that the Department are considering refusing your visa on the basis of having failed PIC 4020, we can help you draft a detailed response and advise on what evidence you should provide to demonstrate that you were telling the truth. If your visa is refused on the basis of PIC 4020 you may have review rights which we can advise you on.
